Terms of Use for Komatoon

Welcome to Komatoon! These Terms of Use ("Terms") govern your use of the Komatoon iOS application ("App") and its related photo editing and AI image generation services (collectively, the "Service"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service and AI Generation

Komatoon provides artificial intelligence-based image transformation services. By using the Service, you acknowledge that:

• AI generation is inherently unpredictable. We do not guarantee that the resulting images will perfectly resemble the original subject, nor do we guarantee specific artistic results.
• The Service relies on complex cloud infrastructure. While we strive for high availability, generation requests may occasionally fail, time out, or experience delays due to server load or maintenance on our cloud GPU infrastructure. We are not liable for temporary interruptions to the Service.

2. User Content and Storage

To use the Service, you must upload a photograph ("User Content").

• Ownership & Rights: You retain all ownership rights to your User Content. You represent and warrant that you own the photo or have the explicit legal permission to use and upload it.
• License to Process: You grant Komatoon a temporary, non-exclusive license to upload your User Content to our secure cloud storage strictly for the purpose of processing the image through our AI models and returning the result to you.
• Data Deletion: We do not claim ownership of your photos. Uploaded images and generated results are stored temporarily for up to 30 days—strictly to facilitate the Service and allow you to retrieve your results—as detailed in our Privacy Policy.

3. Prohibited Conduct

You agree NOT to use the Service to upload, generate, or share content that:

• Contains exploitative, harmful, or unauthorized images of minors.
• Is sexually explicit, pornographic, or non-consensual (including deepfakes).
• Is hateful, harassing, violent, or promotes illegal activities.
• Infringes on the copyrights, trademarks, or privacy rights of any third party.

Komatoon reserves the right to suspend or terminate your access to the Service at any time, without notice, for violating these rules.

4. Purchases and Subscriptions

All payments, subscriptions, and refunds are handled entirely by Apple via the App Store. Komatoon does not process your payment information. If you require a refund, you must request it directly through Apple’s App Store procedures.

5. Intellectual Property

The Komatoon App, its design, logos, and the underlying technology are the property of Komatoon. You may not reverse-engineer, decompile, or attempt to extract the source code or the specific AI workflows used by the Service.

6. Limitation of Liability

To the maximum extent permitted by law, Komatoon and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; or (c) any generated output that you or a third party may find offensive or inaccurate.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.

8. Changes to These Terms

We may update these Terms from time to time. If we make changes, we will notify you by updating the date at the top of this document.
